Can a convicted felon own a black powder ball and cap pistol?

I know that under federal law, black powder weapons that are made before a certain year are not considered ';Firearms';. Also replicas of said weapons are not considered Firearms.Can a convicted felon own a black powder ball and cap pistol?
State law may trump that exception, but generally speaking if the object is not a fireable weapon, it should be ok.

The probation agent and judge may not have that view. Considering that it still can kill someone at range.
