Can a felon own a black powder gun in Alaska?

I don鈥檛 think they can, but a friend of mine insists they can, can you help end this debate?





Can a felon own a black powder gun in Alaska?
No Grrr it is not a gun, at least not a firearm under the legal definition of firearm


As long as the weapon was made before 1899 or is a replica of a gun made before 1899 and does not use rimfire or centerfire ammunition it violates no federal law for a felon to be in possession of one





If we follow Johnny's logic then no Alaska would not allow it because it is allowed in many other states





And there is no ';gun check'; on BP guns





Alaska's definition of firearm IS different though


AS 11.81.900


';firearm'; means a weapon, including a pistol, revolver, rifle, or shotgun, whether loaded or unloaded, operable or inoperable, designed for discharging a shot capable of causing death or serious physical injury;





Alaska's law forbids a felon from owning a firearm capable of being concealed within ten years of completing his sentence including parole or probation





So it seems that a felon can possess a black powder rifle but not a handgun but then he can also possess a cartridge rifle but not a handgun if within ten years of being put back on the street without supervision





But he can still be charged with violation of federal statutes for carrying a firearm even if Alaska allows it


So


He would be safe from all prosecution is he carries a BP revolver if it is more than ten years after his release form state controlCan a felon own a black powder gun in Alaska?
First, He needs to check with local law officials. It probably depends on the reason for the conviction.


Second, you people answering these questions need to study the subjects. Yes black powder shoot bullets. But they are NOT classified as firearms. If they were then why can you mail order them and not a shotgun or rifle? Hmmmm. Why do most states have a Muzzle Loader season and a Firearms season for deer?
Sure you can. Once you have completed your probation period the case will be officially dismissed by the courts. The conviction will still remain on your record for life but once it is dismissed you are allowed to posses firearms again.
is it a gun? yes. is he a felon? yes.





the answer is no.
Felons cannot own firearms of any kind in any state in the United States. A gun check is suppose to catch that
I'm pretty sure you can't. But they might have different laws up there.
